Loi sur le sport professionnel, les ligues en désaccord

Plusieurs ligues professionnelles ont exprimé leur « profond désaccord » et leur « totale incompréhension » avec la proposition de loi visant à réformer le sport professionnel portée par les sénateurs Michel Savin (LR) et Laurent Lafon (UDI) dans un courrier dont l’AFP a obtenu une copie mercredi.

« Nous tenons à vous faire part de notre totale incompréhension et profond désaccord avec les dispositions relatives aux relations institutionnelles entre les fédérations et les ligues professionnelles », écrivent les présidents des ligues de football (Vincent Labrune), de basket-ball (Philippe Ausseur), de cyclisme (Xavier Jan), de handball (Fabrice Boutet), de rugby (Yann Roubert), de volley-ball (Jean Azéma), ainsi que le patron de l’Association des Ligues de Sport Professionnel (David Tebib).

« L’architecture de la proposition de loi emporte en effet un risque de fragilisation des ligues et de déstabilisation du modèle sportif français, à rebours de tous les travaux menés depuis dix ans sur le sujet et en contradiction avec l’objectif affiché de renforcer l’efficacité de l’organisation institutionnelle et la performance globale du sport professionnel », ajoutent ces dirigeants dans leur courrier adressé aux deux sénateurs.

Ils regrettent que les dispositions soient « présentées au seul prisme des travaux menés par la mission sénatoriale sur le football, sans aucune concertation, donc, avec les institutions des autres disciplines ni analyse de leur situation » et se disent « choqués par ce manque de considération pour la diversité des sports professionnels, qui bien moins exposés que le football, ont tous développé leur propre modèle et sont pour certains des références européennes voire mondiales de leur discipline. »

La proposition de loi déposée le 19 mars 2025 au Sénat propose notamment de renforcer le contrôle de la Fédération Française de Football (FFF) sur la Ligue de Football Professionnel (LFP).

En rappelant que les ligues professionnelles « exercent une subdélégation de service public », le texte offre la possibilité aux fédérations de la lui retirer, avant l’échéance prévue, en cas de « manquement à l’intérêt général de la discipline. »

Les deux sénateurs souhaitent également renforcer le contrôle et le suivi des budgets des clubs et des ligues professionnelles, renforcer les contrôles sur la création d’une société commerciale par une ligue, et en améliorer la gouvernance.

Les dirigeants des ligues professionnelles estiment, eux, qu’en « restant en l’état, la proposition de loi accélérera inéluctablement les projets de compétitions privées (…) sur lesquelles nos instances n’auraient pas de contrôle. »

Dans un entretien accordé aux Échos mercredi, le président de la Ligue de Football Professionnel (LFP) Vincent Labrune a précisé que les articles 2 et 7 de la proposition de loi « ne vont pas du tout dans le bon sens. »

Selon le patron de la LFP, l’article 2 « donne potentiellement un droit de vie ou de mort aux fédérations sur toutes les ligues professionnelles. » « C’est pour nous, comme il me semble pour l’ensemble des ligues, une vraie ligne rouge », a-t-il indiqué.

« L’article 7, qui accorderait le droit aux fédérations de décider de la répartition des revenus des clubs, doit être supprimé. Cela reviendrait à revenir 40 ans en arrière. Cette prérogative doit revenir aux clubs, qui gèrent leur stratégie financière et leurs priorités. D’autant plus que ce sont
les clubs qui sont propriétaires des droits TV depuis 2004 », a-t-il expliqué.

Le dirigeant estime en revanche « que le nouveau modèle de gouvernance qui reposerait, si l’on schématise, sur la fédération et sur une société commerciale (…) mérite d’être creusé » et se montre favorable à la création d’un délit de piratage et au renforcement des pouvoirs de l’ARCOM.
