TERMS AND CONDITIONS
These Terms and Conditions apply to this online Competition which is being run by the Promoter, a member of the World Rugby group of companies (“World Rugby Group”). Once accepted by you, these Terms and Conditions shall apply to you and shall form a legal binding contract with you in relation to this Competition. Please read these Terms and Conditions carefully before submitting your entry into this Competition.
Unless expressly defined within the Terms and Conditions below, terms used in these Terms and Conditions shall have the meaning as defined in the Key Terms above.
- This Competition offers eligible individuals who successfully submit an entry (the “Entrant”) with an opportunity to win the Prize(s).
- Notice regarding personal data: By entering this Competition, you agree that the Promoter will use and process your personal data for the purposes of managing, administering and facilitating the Competition, including your entry into the Competition. You agree that the Promoter and/or the Competition Partner will be able to receive your personal data in order to contact you if you are selected as a winner of the Competition to discuss the awarding and distribution to you of the Prize. The Promoter shall process all personal data it collects from you during this Competition in accordance with the Promoter Privacy Policy available here. The personal data which you submit in connection with this Competition shall be used for: managing your entry into the Competition, providing you with the opportunity to win the Prize(s), sharing the contact details of each winner with the Competition Partner so the Competition Partner can fulfil and distribute the Prizes, where you have consented (including consented to the Promoter sharing your information with the Competition Partner) for the purposes of receiving marketing information from the Promoter or the Competition Partner, for purposes that have been agreed by you in advance or otherwise such use and processing as outlined in the Promoter Privacy Policy (see link above). Your personal data will not be used for any purpose which is incompatible with the purposes of facilitating your entry into this Competition and/or the purposes outlined above.
- The personal information relating to you that we will collect in relation to your entry will include:
- Your first and last name;
- Your email address;
- Your country of residence;
- Your date of birth;
- Your responses to any Competition questions;
- If you win a Prize, we may need to collect your postal address and a contact number; and
- Any correspondence we have with you in relation to our consideration of your entry.
- Your consent to the provision and use of your personal data above is a pre-condition to you entering this Competition and the relevant consents are required prior to entry.
- You may withdraw your consent at any time by writing to us at dataprotection@worldrugby.org. However, if an individual withdraws their consent to us using their personal information as described above, we will no longer consider their entry and they will forego their opportunity to win the Prize(s). An additional category of personal data that may be collected from you in relation to your entry will be your consent to receive marketing information, but only if you agree to provide such consent, from the Promoter and/or the Competition Partner(s). If you consent to our sharing of your personal data with the Competition Partner(s) to allow the Competition Partner send you marketing emails and information, your personal data will be processed by the Competition Partner, as the data controller of your personal data, in accordance with the Competition Partner Privacy Policy (see Key Terms above).
- Acceptance of these Terms and Conditions is a condition of entry into the Competition and the entry instructions below form part of these Terms and Conditions. Prior to submitting an entry and as a condition of eligibility for winning a Prize, the winner shall be required to confirm agreement and acceptance of these Terms and Conditions.
- This Competition is strictly open only to those individuals who satisfy in full the Competition Eligibility Criteria (see Key Terms above).
- This Competition is not open to employees of the Promoter, the World Rugby Group or the Competition Partner or a member of any of their immediate families and is not open to any Promoter, World Rugby Group or Competition Partner associated companies, agents, third parties or anyone else professionally connected with this Competition (and their immediate families). Any individuals trying to circumvent this rule by using alternative entry or contact details will be disqualified from the Competition.
- The Promoter reserves the right to verify the eligibility of any Entrant. The Promoter may require such additional information as it considers reasonably necessary for this verification purpose and a Prize may be withheld unless and until the Promoter is satisfied with the verification in its sole discretion.
- Entry into this Competition is free and no purchase is necessary.
- How to enter:
- You will be asked to successfully complete the Competition Activity;
- In order to enter the Competition, you must submit the requested information (including your personal details) via the form hosted on the Competition Page. The information you submit will be processed by the Promoter in accordance with the Promoter Privacy Policy (see link above);
- The Competition will have a Prize pool draw in relation to the Prize(s) which shall take place after the Competition Period ends. If you complete the Competition Activity successfully, your entry will be deemed a “qualifying entry” and your entry will go forward for entry into the Prize pool draw(s).
- To enter the Competition, you will require internet access and an e-mail account. By entering this Competition, the Entrant warrants that their entry does not infringe the intellectual property rights of any third party.
- The winner(s) of the Competition will be selected from those Entrants who completed the Competition Activity successfully. The group of Entrants who answered correctly will go into a random Prize(s) draw using a computer process that produces verifiably random results in accordance with the laws of chance which will be conducted by the Promoter. In the event of a dispute related to winner selection, the decision of the Promoter is final.
- The Competition shall run only for the length of the Competition Period, unless extended or shortened at the sole discretion of the Promoter. Any entries received before or after the Competition Period will not be valid for or entered into the Competition.
- All valid entries that are submitted and have successfully completed the Competition Activity during the Competition Period will become eligible to win the Prize(s).
- Where the Prize is for, or includes, tickets, experiences or any other destination/location-based events, the Prize shall not include any flights, accommodation, internal travel, food, drink or any other expense or associated costs of any kind, unless it is clearly stated as being included in the Prize. The Promoter is not responsible for visa, immigration or travel requirements that may apply in travelling to and/or from the event or experience, or as a result of winning, collecting, use or enjoyment of any Prize. Use of any such tickets or experiences is subject always to all terms and conditions applicable to such tickets and/or experiences and any regulations in force at the applicable venue or event.
- Any Prize won (including any tickets) in connection with this Competition may not be resold under any circumstances.
- Any Prize provided by third parties may be subject to additional terms and conditions from those third parties (and/or from the supplier or manufacturer of the Prize) and the winner shall comply with such terms and conditions. A failure to agree to these terms and conditions may result in the applicable Prize being offered to another Entrant.
- Bulk entries made from trade, consumer groups or any other third parties will not be accepted. No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions. Any entry that is deemed as offensive, inappropriate, obscene, unlawful or contain otherwise objectionable content or information will not be granted approval and will therefore be excluded from the Competition. In addition, the winner shall not, in connection with their entry or this Competition or the Prize, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to be ambush marketing or an abuse of the Competition Partner, the Promoter and/or the World Rugby Group. The winner shall not, in connection with their entry or this Competition or the Prize, display or publicize any content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights) or reflects negatively upon the Competition Partner, Promoter and/or the World Rugby Group.
- The Promoter may, in its sole discretion, disqualify entries deemed to be non-compliant with these Terms and Conditions and the Promoter reserves the right to refuse entry to or disqualify any Entrant whose conduct may be unlawful or otherwise bring the Competition into disrepute. In the event of such disqualification, the Promoter may award the applicable Prize to another Entrant.
- No responsibility is accepted by the Promoter for entries lost, damaged or delayed as a result of any network, or computer hardware or software failure of any kind or removed from any social media platform as a result of third party rights breach or a breach of the rules of any social media platforms.
- By participating in this Competition, you agree to release, discharge and hold the Promoter, the World Rugby Group, the Competition Partner and their affiliates from any and all injuries, liability, losses and damages of any kind resulting from your participation in this Competition (save that nothing shall limit liability for fraud, or for death or personal injury caused by negligence of the above parties).
- The Prize(s) are non-exchangeable, non-transferable and non-refundable and there is strictly no cash alternative in whole or in part for any Prize. The Promoter reserves the right, at any time, to terminate or modify the Competition, including modification of these Terms and Conditions, vary details of the Prize(s) (or any part thereof), or substitute a Prize(s) of equivalent value should unforeseen circumstances arise and require substitution by the Promoter. The Promoter is entitled to terminate or modify the Competition or these Terms and Conditions at its sole discretion at any time prior to, during or after the Competition Period for any reason without liability or compensation to any Entrant
- The Promoter shall not be liable for any Prize(s) which is lost, delayed or damaged in the post or otherwise not received by the winner. Any expenses or losses incurred by a Prize winner in the use and/or enjoyment of a Prize, are the sole responsibility of the Prize winner and neither the Promoter nor the World Rugby shall be liable or responsible for such expenses or losses.
- Following the Prize draw(s), the Prize winner will be notified by e-mail, using the e-mail address provided by the Entrant at the time of submitting their entry, within 30 days of the end of the Competition Period.
- The Prize winner must respond within 7 days of the above notification by the Promoter to claim their Prize by replying to the e-mail message and supplying any requested details which may include their phone number and/or an address to which the Prize can be delivered (if physical delivery is required). If the winner does not responded within the above timeframe, the winning of the Prize(s) will lapse and the Promoter reserves the right, in its sole discretion, to offer the unclaimed Prize to a substitute winner selected in accordance with these Terms and Conditions. In such case, the original winner shall have no further entitlement or right to any Prize(s).
- Neither the Promoter nor the World Rugby Group nor the Competition Partner shall be liable (to the extent permitted by law) for any loss or damage arising out of organising or holding this Competition or as a result of an individual’s participation in the Competition and/or any attendance or activities pursued by the Prize winner and/or their guest/s while at any event or experience relevant to the Prize(s), including whilst travelling to and/or from such event or experience, or as a result of winning, collecting, use and/or enjoyment of any Prize, or if the Competition does not run as planned or advertised. This clause does not seek to exclude the liability of the Promoter or the World Rugby Group or the Competition Partner for (a) death or personal injury caused by their negligence, (b) fraud or fraudulent misrepresentation, and/or (c) any other liability for which it would be unlawful for the Promoter and/or World Rugby Group and/or the Competition Partner to exclude or attempt to exclude.
- The winner may be required to participate in publicity arising from this Competition as may be reasonably required by the Promoter and/or the Competition Partner with no recompense and the winner, on behalf of themselves and their guests, agrees to such publicity and the use by the Promoter and the World Rugby Group and the Competition Partner of their and their guest’s image throughout the world in any media, known now or in the future, in perpetuity.
- The winner acknowledges and agrees that, once a winner has formally accepted the Prize, the winning entry and the details of the name and general geographical location of the winner may be published by the Promoter on any Promoter or World Rugby website or platform and/or by the Competition Partner on any Competition Partner website or platform, including social media platforms, and may be viewed globally, without any payment or compensation due or payable to the winner.
- If, by reason of any Force Majeure Event, the Promoter shall be delayed in, or prevented from, performing any of the provisions of this Competition then, provided that the affected party is promptly notified of the nature and extent of the Force Majeure Event, such delay or non-performance shall not be deemed to be a breach of this Competition or these Terms and Conditions and no loss or damage shall be claimed by the affected party hereto from the other by reason thereof.
- Should the exercise of the rights and obligations under this Competition be materially hampered, interrupted or interfered with by reason of any Force Majeure Event, the obligations of the Promoter shall be suspended during the period of such hampering, interruption or interference consequent upon such event or events and shall be postponed for a period of time equivalent to the period or periods of suspension before being reinstated (if possible and practical) and the parties hereto will use all reasonable endeavours to minimise and reduce any period of suspension occasioned by such event of Force Majeure Event.
- In these Terms and Conditions, the expression “Force Majeure Event” shall mean any cause or event outside the reasonable control of the parties and shall include fire, flood, earthquake, casualty, satellite failure, public health emergency or events arising out of or caused by Covid-19 or similar situations, lockout, strike, labour condition, industrial action of any kind, working to rule, unavoidable accident, breakdown of equipment, national calamity or riot, civil commotion, malicious damage, act of God, any cause or event arising out of or attributable to actual or perceived terrorism, or any other cause or event (whether of a similar or dissimilar nature) outside the control of the parties.
- These Terms and Conditions and any issues or disputes which may arise out of or in connection with these Terms and Conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law and, on an irrevocable basis, the courts of England shall have the exclusive jurisdiction to hear or settle any such disputes or issues arising in relation to these Terms and Conditions.
- In the event that any provision of these Terms and Conditions shall be determined to be partially void or unenforceable by any court or body of competent jurisdiction or by virtue of any legislation to which it is subject or by virtue of any other reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of these Terms and Conditions shall not be affected.
